ORDINANCE NO. ______ AN ORDINANCE AUTHORIZING THE LEASE OF REAL ESTATE OWNED BY THE VILLAGE OF ANTWERP, OHIO PURSUANT TO OHIO REVISED CODE SECTION 721.03; AND DECLARING THE SAME AN EMERGENCY WHEREAS, the Village of Antwerp, Ohio, owns real estate consisting of 22.4 acres of tillable farm ground, located in Section 35 of Carryall Township, more particularly described in Exhibit A attached hereto and incorporated herein by reference (the “Real Estate”). WHEREAS, the Real Estate is not needed for any municipal purpose and the Council of the Village of Antwerp, Ohio, deems it necessary to let bids for the lease of said Real Estate to be occupied and used for agricultural purposes only. WHEREAS, the Council, pursuant to Ohio Revised Code Section 721.03 desires to lease the Real Estate for agricultural purposes only to the highest bidder, after advertisement once a week for five (5) consecutive weeks in a newspaper of general circulation within the Village of Antwerp, Ohio. NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Antwerp, Paulding County, Ohio, as follows: Section 1. That the Real Estate be leased to the highest bidder for agricultural purposes only, said lease to be for a five (5) year period commencing from the Effective Date of the Lease Agreement by and between the Village of Antwerp, Ohio as the landowner and the highest bidder as the renter. Section 2. That the Fiscal Officer for the Village of Antwerp is hereby instructed and directed to cause legal notice to bidders to be published for five (5) consecutive weeks in a newspaper of general circulation within the Village of Antwerp, Ohio. The Village of Antwerp reserves the right to reject any and all bids. Section 3. That attached hereto and marked as Exhibit B is a true and accurate copy of the proposed form Lease Agreement to be used by the Village of Antwerp, Ohio, containing the terms and conditions of leasing the Real Estate, and said terms and conditions are incorporated herein by reference. Said proposed form Lease Agreement is to be made available to prospective bidders. Section 4. It is found and determined that all formal actions of the Council concerning or relating to the passage of this Ordinance were adopted in an open meeting of the Council, and that all deliberations of the Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, including all lawful ordinances and any applicable provisions of Section 121.22 of the Ohio Revised Code. Section 5. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the welfare, convenience and prosperity of the Village of Antwerp and necessary to permit the letting of bids for the lease of the Real Estate for agricultural purposes only prior to the commencement of the planting season, and this Ordinance shall be in full force and effect immediately after its passage; otherwise, it shall take effect and be in full force after the earliest period allowed by law.
